This can be determined where the conduct of such a promotion is done either in the media (print or electronic) or in connection with a trade or business, or the sale of an article to the public. There must be an entrance fee, stake, contribution or subscription payable for a right to enter or participate. For an event to be considered a promotion; there must be some benefit to be gained by the promoter (business).

Yes you do, under The Betting, Gaming & Lotteries Act (BGLA) section 58 (3), which states: “The Commission may authorize in writing any person to conduct a competition under this section on such terms as he thinks fit”.

The Commission offers two (2) services to persons who are interested in carrying on a prize competition.There is the regular service and an express service.

For the regular service, all “completed” applications must be submitted at least fourteen (14) days prior to the proposed start date. However, where an application is submitted less than fourteen (14) days prior to the start date, but not less than five (5) working days prior to the start date, a late fee shall be charged. The express service is available where completed applications are submitted within two (2) to five (5) working days prior to the commencement date and shall attract an express delivery fee.

The following relevant fees must accompany an application;

  • Total value of Nominal Prizes (value of prizes being offered to participants) less than or equal to $500,000.00 will attract a fee of $20,000.00.
  • Total value of Nominal Prizes (value of prizes being offered to participants) greater than $500,000.00 and less than or equal to $1,000,000.00 will attract a fee of $50,000.00.
  • Total value of Nominal Prizes (value of prizes being offered to participants) greater than $1,000,000.00 will attract a fee of $100,000.00.

In addition to the fees already mentioned, the following fees will apply where applicable;

  • Incomplete Application - $15,000.00.
  • Late Application (less than 14 days before the start date) - $15,000.00.
  • Extension of expiry date of Promotion - $15,000.00.
  • Express Service Fees (applications submitted within 2 to 5 working days before the start date of promotion) - $25,000.00.
  • Modifications or Amendments after approval for competition - $15,000.00.
  • Withdrawal after approval of a promotion is non-refundable.
  • Cancellation before approval of promotion will attract a 25% administrative fee on all applicable fees already paid.

In order to know if a Prize Promotion Competition is approved by the Betting, Gaming & Lotteries Commission, all promoters must ensure that the application to conduct such an event meets the required rules of the Commission.Once all the requirements have been met a letter of Approval and Authorization will be issued to the promoter.

As it relates to the public, the promoter is required to state that the promotion is “Authorized under section 58(3) of the Betting, Gaming and Lotteries Act”.

Yes you do.A specific description of the prize/s must be given along with evidence of its existence for this purpose.The following information is required in relation to the corresponding prizes, along with any other information deemed necessary;

  • Appliances – the brand, size and model number.
  • Motor Vehicles – the year, make, model and type must be stated.
  • Weekend at a Hotel – the duration, number of persons to be accommodated, type, who should bear taxes or fees that may accrue and any blackout days.
  • Trips Abroad – the duration, carrier, type of ticket, entity responsible for payment of taxes and fees, accommodation, whether prize is transferable, disclaimer in relation to travel documents where spending money is applicable, the amount and currency should be declared.  In relation to weekend at hotel and trips abroad, any blackout dates must be stated.

In the event that a prize is no longer available as specified in the promotional materials, a prize of an equal or higher value but similar in nature should be given to the winner.

A detailed account of all the mechanics and rules relating to the proposed competition is required and should include, but not be limited to factors such as:

  • An application of an age restriction, however, this is left to the discretion of the promoter.

There is no prescribed Application form however a completed Application should contain all details of the proposed competition including the following;

  • Name of the competition
  • Duration of the competition
  • Mechanics/Rules of the competition
  • Method of selecting winner/s
  • Date of selection of winner/s
  • Method of notifying winner/s
  • Promotional materials to be used to advertise the promotion
  • Details of prize/s
  • Claiming period
  • Fees
  • Submission and approval of application
